NOTICE Chapter 229, Rule §229.372 of the Texas Administrative Code, requires temporary food establishments in areas not currently permitted and inspected by a county, local health department, or public health district, to be permitted by the Texas Department of Health (TDH). The permit fee is $35.00 per individual site, is valid for a single event, and will not to exceed 14 consecutive days from the initial start date of that event.
A “food establishment” is “An operation that stores, prepares, packages, serves, or otherwise provides food for human consumption....” The term includes any such place, regardless of whether the consumption is on or off the premises and regardless of whether there is a charge for the food. A “temporary food establishment” is defined as “A food establishment that operates for a period of no more than 14 consecutive days in conjunction with a single event or celebration.” Nonprofit organizations are not required to submit an application or pay the permit fee, but shall meet the minimum operating guidelines.
Applications for a temporary food establishment permit must be received by the TDH at least 30 days prior to the event. Faxed copies of applications and/or faxed copies of checks are no longer accepted for permit issuance. While the burden of permitting falls on the temporary food establishment operators, the rule also states that “An organizer of an event at which a temporary food establishment is operated shall assure a permit from the department is obtained for each temporary food establishment.” Additionally, no permits will be issued to any operators owing previous permit fees until all past due fees are paid.
